By accessing or using our Services (defined below), and communicating with us, you agree to be bound by all Tympanon, LLC (“Tympanon”, “we”, “our”, or “us”) policies (the “Tympanon Policies”), including this Privacy Policy. Any capitalized or defined term (including “you” and “user”) not defined in this Privacy Policy, shall have the meaning as defined in our Terms of Use which is a separate document which outlines the legal contract between you and Tympanon for using our Services.
At Tympanon, LLC we recognize your privacy is important. This Privacy Policy discloses how we collect, use, and disclose personal data obtained as a result of your use of the Services or that is received by email or other communications we have with you, or that you provide to us in any manner. It does not apply to information you may submit to our Service Providers (defined below) or to companies or organizations to which we may link or who may link to us.
BY USING OUR SERVICES, YOU ARE PROVIDING YOUR INFORMED CONSENT THAT ALL PERSONAL DATA YOU SUBMIT, OR THAT IS SUBMITTED TO US FOR OR ABOUT YOU BY OTHERS, MAY BE USED, PROCESSED, AND DISCLOSED IN THE MANNER AND FOR THE BUSINESS PURPOSES DESCRIBED IN THE TYMPANON POLICIES. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU MAY NOT USE OUR SERVICES.
IF YOU DECIDE LATER THAT YOU DO NOT CONSENT TO THIS USE OF YOUR PERSONAL DATA, PLEASE INFORM US IN WRITING BY COMPLETING AND SUBMITTING THE OPT-OUT FORM.
We reserve the right to modify this Privacy Policy from time to time. If at any time you disagree with any of the Tympanon Policies, including this or any modified Privacy Policy, your only recourse is to immediately discontinue use of our Services.
1. Services. Tympanon is a cloud-based audio streaming service where users may easily consolidate media assets they own or have a right to access and use, including, without limitation, music, videos, and podcasts, into their own library through our website and/or applications, which includes our software, sites, and the content contained or accessible through them (the “Services”).
2. Privacy Policy. This Privacy Policy applies to your use of our Services on any device or equipment, the personalization of your user experience, the infrastructure required to provide the Services, and connection to any other service, device, or equipment. This Privacy Policy is not the Tympanon Terms of Use, which is a separate document that outlines the legal contract between you and Tympanon for using the Services. This Privacy Policy does not apply to personal data collected by the manufacturer of any device or equipment through which you access the Services or that is collected by a third party, including, without limitation, social identity and commerce providers .
3. Permitted Regions. The Services are controlled and operated from the United States. If you are not a resident of the United States using the Services in the United States, please do not interact with the Services or otherwise provide us with your personal data. To enforce our territorial limits, we may collect information associated with a device or equipment to determine the country from where the device or equipment is accessing the Services. If we determine that your device or equipment is located outside the United States, we may block your access to the Services from that particular device or equipment. If you attempt to access the Services when you are outside the United States, we will use your IP address for the legitimate interest of allowing or denying access to geo-restricted content within our Services. If you disable such geolocation on your device or equipment and we have no other method of determining your location and whether you are within our service territory, then you will not have access to the geographically restricted channels on your device or equipment regardless of your location.
4. Age Limit. Users must be at least 18 years old to access and use our Services. The Services are not directed to persons whose age (a) is younger than 18, (b) makes it illegal to process their personal data, or (c) requires parental consent to process their personal data. We do not knowingly collect any personal data from individuals in these categories. If you fall within these categories, please do not interact with the Services or otherwise provide any of your personal data to us. Further, by using the Services you agree not to allow any person who falls within these categories to use the Services or provide any personal data to us. If you become aware that an individual meeting any of these categories has provided personal data to us, please contact us immediately at privacy@tympanon.llc. If we learn that we’ve collected personal data of any such person, we will take reasonable steps to delete the personal data.
5. Personal Data. In order to provide the Services to you, we collect several types of information about our users.
a. Personal Data. We collect personal data about you when you engage with the Services, including, without limitation, contact information and other personally identifiable information (collectively “personal data”). Examples may include your first and last name, email address, mailing address, telephone number, date of birth, gender, photograph or image, password, and your preferences. The most common ways you provide your personal data to us is by setting up a user account providing us access to your digital media, providing confirmation of your legal rights to your digital media, and when communicating with us electronically or otherwise.
b. Usage Data. When you use the Services, we collect personal data about your search queries, browsing history, streaming history, media library, playlists, account settings, interactions with other Tympanon users, use of third party services, inferences based on your interests and preferences, and content you provide when using the Services.
c. Non-personal Data. When you interact with us, we may also collect certain information that does not identify you individually, we may anonymize and/or aggregate information about our users in a manner that does not allow any user to be personally identified, and/or our servers may automatically keep an activity log of your use of our Services.
d. Source IP Address and Account Data. We collect and store information about devices and equipment you use when accessing the Services, including, without limitation, network connection type, network provider, network and device or equipment performance, URL, browser type, language, information enabling digital rights management, operating system, device’s IP address, which may disclose the physical location of your device or equipment when you access our Services, and we may also store other information we learn about you associated with your account. If this information can allow someone to learn your identity, we treat it like other personal data.
e. Cookies. Like many websites and applications, we use “cookies,” which are small text files or other technologies that are stored on your computer, tablet, phone, or other device or equipment when you use our applications or visit certain online pages and that record your preference and actions. We use cookies, and we may allow our Service Providers to use our cookies or place their own cookies on your device or equipment. Please be advised that if you do not accept cookies, you cannot login or use our Services. If you delete your cookies or if you set your web browser to decline cookies, our Services will not work.
f. Global Privacy Control (GPC) and Do Not Track (DNT) Signals. Global Privacy Controls (“GPC”) and Do Not Track (“DNT”) offered by some web browsers are settings that automatically inform websites of your privacy preferences. When you choose to turn on the GPC/DNT setting in your browser, your browser sends a special signal to websites, analytics companies, ad networks, plug in providers, and/or other web services you encounter while browsing to exercise your privacy rights and stop tracking your activity. We comply with GPC as required under applicable law, but because there is not yet an accepted standard for how to respond to browser DNT signals, we do not currently respond to them.
g. Third-Party Analytics. We use third-party analytics services (e.g., Google Analytics) to evaluate use of our Services through our applications and/or website, compile reports on activity, collect demographic data, analyze performance metrics, and collect and evaluate other information relating to usage. These analytics providers may use cookies and other technologies to help analyze and provide us the data analytics. You may opt-out of certain third-party analytics services we use, including, without limitation, certain Google Analytics, through your device or equipment settings, such as your device advertising settings and/or by following the instructions provided by Google or other third parties in their privacy policy. In addition, you can opt-out of having your activity while using our Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. You can learn about Google’s practices, and opt-out of them by downloading the Google Analytics opt-out browser add-on.
Please be advised that if you opt-out, you may not be able to use the full functionality of our Services, and if you use multiple browsers and/or devices or equipment, you will need to opt-out for each one.
6. How We Use Personal Data.
a. Consistent with Your Intent. We collect, use, process, and disclose personal data only with the understanding that by using our Services you intend to and have agreed to use our Services to intentionally interact with third parties, and that you direct us and such third parties to intentionally disclose your personal data for the business and commercial purposes described in the Tympanon Policies and/or available through our Services. We use and process personal data so that we can offer, tailor, and deliver content, features, services, and software in connection with the Services we provide consistent with our business purpose. For example, when you represent that you have a right to use specific digital media assets, you will be required to provide various types of personal data in order to use our Services to access your media libraries and streaming services.
The only way we can provide the Services we offer to our users and that you have requested of us, is if you: (a) voluntarily provide personal data to us, (b) direct us to intentionally disclose your personal data to certain third parties; and (c) use our Services to intentionally interact with such third parties. If this is not your intent, we cannot provide our Services to you and do not authorize you to use our Services, including our applications or website.
b. Our Applications and Website. Generally, we use your personal data to permit us to provide the storage, features, services, and software through our applications and website and to continually improve your experience. For example, we may use your personal data and/or non-personal data in the following ways:
· Provide verified and secure access to the Services
· Permit us to connect to your media content
· Disclose it to third parties who support us in providing the Services
· Communicate with you about your account and use of our Services
· Provide user support
· Personalize content and experiences, including providing tailored services and recommendations
· Optimize or improve our features, software, and Services
· Diagnose issues with our applications, website, or the servers we use
· Detect, investigate, and prevent activities that may violate our Tympanon Policies
· Perform user statistical, demographic, and marketing analyses
c. Marketing; Communications. We may, from time to time, use your personal data to send you messages through our applications and/or website, or by email or text regarding the Services which may be of interest to you. If you do not want to receive such information from us, you can “opt-out” by changing the permissions in your user account profile to stop receiving such offers or unsubscribing from any marketing emails or newsletter we send you through the link included in the footer of such email. You may also opt-out of our email marketing communications by sending your request to us at opt-out@tympanon.llc. If you wish to opt-out of receiving text marketing messages from us, you may unsubscribe by replying “STOP” to the text message. Even if you opt-out of receiving such offers or information, when you access our applications or website, use our Services, or communicate with us electronically, you consent to receive non-marketing communications from us electronically by any means, including by notices or messages through or posted on our applications and/or website.
7. We Do Not Sell Your personal data. We do not allow marketing companies, advertisers, or similar companies to access personal data in exchange for payment. In no event will we sell or rent personal data to third parties for monetary compensation.
8. Health Information. We do not collect, share, sale, or use health-related data about consumers. Please do not provide this type of information to us.
9. Disclosure of Personal Data. Your personal data may be disclosed to the following categories of third parties for the uses, including business or commercial purposes, as explained in this Privacy Policy.
a. Service Providers. We use services providers in connection with providing our Services to you, which include those that operate the technical infrastructure we need to provide the Services and cloud computing, verify your right to use or access your digital assets, assist in protecting and securing our systems and Services, help market our Services, process payments, and provide customer support (“Service Providers”). We provide our Service Providers with the limited personal data they need to provide their services to us and to you or as otherwise directed by you. Although our treatment of your personal data is governed by this Privacy Policy, our Service Providers’ treatment of your personal data is not; and it will be governed by their privacy policies.
b. Enforcement. We may disclose your personal data to appropriate governmental authorities in response to a court order, subpoena, other legal process, or to cooperate with a law enforcement investigation, which may include disclosing the jurisdiction where you are located or from where you have accessed our Services. We intend to fully cooperate with law enforcement agencies in identifying those who use our Services for illegal activities or without such use being authorized. We reserve the right to report to law enforcement agencies any activities we, in good faith, suspect may be illegal, including, without limitation, your rights to use or access any content. We may also disclose your personal data when reasonably necessary to preserve, exercise, and/or defend our legal rights.
c. Legal. We may disclose your personal data to resolve disputes, enforce our agreements and policies, protect our or others’ rights or assets, comply with our contractual obligations, cooperate with legal inquiries, and fulfill regulatory reporting obligations.
d. Advertisers and Sponsors. We may disclose your non-personal data to third parties, such as advertisers, but such information will not include any user personal data.
e. Business Transactions. We may disclose your personal data in connection with a merger, acquisition, consolidation, bankruptcy, or other corporate transition affecting all or part of our assets, including during any due diligence inquiry.
f. Security. We may disclose your personal data to protect the Services, investigate, prevent, and protect against issues with our systems or the services we use to provide the Services, fraud, crime, or other activities that violate the Tympanon Policies or applicable laws, and to protect the health and safety of our users or the general public.
g. Other Purposes. We may disclose your personal data as disclosed at the time of collection or with your consent.
10. Transfer and Storage; Duration. We store and/or access your content and personal data in the United States or any other country in which we, or our affiliates or Service Providers maintain facilities. We may transfer personal data across borders and to other countries or jurisdictions around the world, which means we may transfer personal data to a country or jurisdiction that does not have the same data protection laws as the United States. By using our Services, or providing personal data or access to digital media assets, you consent to the transfer to and storage of your personal data in the United States and any other jurisdiction in which we, our affiliates, or Service Providers maintain facilities. In certain limited circumstances, courts, law enforcement agencies, or security authorities in the United States or other jurisdictions may be entitled to access your account (including your personal data). We keep personal data for as long as reasonably necessary for our business purposes and use it only for the purposes for which it was collected, including, without limitation, to comply with any applicable legal or ethical reporting or document retention requirements.
11. Steps We Take to Keep Information Secure. We have designed our Services to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of the content we collect and store, including your personal data.
· We permit you to access your Tympanon account through your social identity provider. We encrypt our communication with these providers, and never process or store your passwords or other social account credentials.
· We implement and maintain reasonable security procedures and practices, including physical, electronic, and procedural safeguards, to protect your personal data.
· We limit internal access to your personal data to our employees, contractors, representatives, and agents who, by virtue of the work they do for us, need to know or have access to your personal data. These individuals or entities are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.
· We caution you that our Services may contain links to other websites or applications operated by third parties. Please be advised that the practices described in this Privacy Policy apply only to our applications and websites, and do not apply to any other website or application. We are not responsible, and expressly disclaim any liability, for the actions and privacy policies of third parties and any other website or application. It is your responsibility to ensure the protection of your personal data and content when using any such third party services.
Unfortunately, no information transmission over the Internet or any wireless network, including transfer of personal data, can be guaranteed to be 100% secure. As a result, while we strive to protect your personal data, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) the security, integrity, and privacy of any and all information, including personal data, exchanged between you and us through our website and applications and your use of the Services cannot be guaranteed.
11. Your Rights. You have the right to know about your personal data that we collect, use, or disclose. This Privacy Policy generally discloses the categories of personal data we collect, the categories of sources from which we collect it, the business and commercial purposes for which personal data is used, and the types of third parties to whom we disclose personal data. You also have the right to:
· Request in writing that we delete your personal data, which we will do unless applicable law permits otherwise for specific purposes.
· Contact us at privacy@tympanon.llc to request (up to two times per year), in addition to the disclosures provided in this Privacy Policy, a listing of your personal data we have collected or disclosed for business purposes in the preceding 12 months. Upon verifying your request, we will provide an electronic copy to you of such personal data in a machine-readable format.
· Designate an authorized agent to exercise these requests on your behalf.
· Not be discriminated against for your exercise of these rights.
12. Requests. Subject to applicable law, we will respond to requests pursuant to this Privacy Policy within 45 days of receipt, which may be extended by an additional 45 days when we consider it reasonably necessary and with notice to you. If we cannot verify your identity or you do not cooperate with us regarding such requests, we may not comply with your request. If your request requires extraordinary cost or effort, we reserve the right to charge you a fee prior to fulfilling your request.
13. Changes to this Privacy Policy. We reserve the right to modify this Privacy Policy from time to time. We will notify you about significant changes in the way we treat your personal data by posting an update to this Privacy Policy in our applications, on our website or by otherwise providing notice to you. Your continued use of our Services after changes are posted or provided will constitute your acknowledgment of the modified Privacy Policy and your agreement to abide and be bound by it to the fullest extent allowed by applicable law. You agree that it is your responsibility to regularly review the Tympanon Policies and to advise anyone to whom you provide an access code or link to a legal proceeding of any changes we make to the Tympanon Policies, including this Privacy Policy.
14. Changing Your Information. You are responsible to maintain the accuracy of the information you submit to us, such as contact information you have provided for your account. You may be able make changes to your account information using the settings under your account. Note that when you edit your personal data or change your preferences, the previous information will be retained internally as part of the history of your account for analytical, administrative, legal and security purposes, or within a backup.
15. Additional Rights May Apply. Residents of some U.S. States may have the ability to exercise additional rights and choices regarding their personal data. While we are committed to taking reasonable steps to accommodate your request, we may need to verify your identity before doing so. Our intention is to comply with the applicable laws of the jurisdiction where you reside. These rights for residents of particular jurisdictions, including, without limitation, California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, Nevada, New Hampshire, New Jersey, Rhode Island, Tennessee, Texas, Oregon, Utah, and Virginia, may include:
a. Access. The right to confirm whether we are processing your personal data and request to access such data, obtain a copy of the personal data you previously provided to us and, to the extent feasible, in a readily usable format to allow data portability.
b. Additional Information. The right to request a list of specific third parties to which we may have disclosed any of your personal data.
c. Delete Your Information. The right to request the deletion of your personal data, subject to certain exemptions and exceptions.
d. Correct Your Information. The right to correct the personal data we hold about you. If you wish to correct your personal data, please change it in your account settings or contact us at data.correction@tympanon.llc.
e. Sensitive Data. The right to opt-out of the processing of any sensitive data, as defined by the laws of the jurisdiction where you reside, to the extent we process any such data.
f. Opt-Out of Sale of Your Personal Data and Targeted Advertising. The right to opt-out of the “sale” of personal data or from the use of personal data in “targeted advertising”. While we do not sell personal data to third parties for monetary compensation, sharing of IP address or mobile IDs with third party advertising vendors and certain other targeted advertising practices may constitute a “sale” under definitions set forth in the applicable laws where you reside.
g. Cookie Based Opt-Outs for Sale and Targeted Advertising. We may use technologies, such as cookies and pixels, in the course of web-based or online advertising, analytics or similar activities that collect or share personal data in a manner that may constitute a “sale” or support “targeted advertising” under the applicable laws where you reside. You may opt-out of cookies set by third parties for advertising or analytics by launching the Privacy Settings from the settings on our application or the footer of our website.
h. Right to Opt-Out of Profiling in furtherance of legal or similarly significant effects. We do not process personal data for the purposes of profiling in furtherance of decisions that produce legal or similarly significant effects.
i. Right to Appeal. The right to appeal our decision relating to your request by contacting us at privacy@tympanon.llc. Please include your full name, the basis for your appeal, and any additional information to consider.
16. Contact Us. You may contact us by email at privacy@tympanon.llc. The information you provide is used to respond directly to your questions or comments. We may also file your comments and share them with our consumer care team to improve our Service in the future. Further, you may be required to take reasonable steps as we determine from time to time to verify your identity and/or the authenticity of requests made by you. Note: in order to process a request from a former or current subscriber/listener, your email address must match the email address on your account.

17. Exercise Your Rights. To take the following steps to exercise your rights as outlined in this Privacy Policy or otherwise. While we are committed to taking reasonable steps to accommodate your request, we may need to verify your identity before doing so.
a. Right to Opt-Out. We give you the right to opt-out of our use, sale, and/or sharing of your personal information by using our online form. While we are committed to taking reasonable steps to accommodate your request, we may need to verify your identity before doing so. Further, you may be required to take reasonable steps as we determine from time to time to verify your identity and/or the authenticity of your request. Note: in order to process a request from a former or current subscriber/listener, your email address must match the email address on your account.
b. Right to Correct Personal Data Only. You may exercise this right directly by contacting us data.correction@tympanon.llc.
c. All Other Applicable Rights. Please submit your consumer data rights request to us at privacy@tympanon.llc.
d. Authorized Agents Submitting Requests. If you are an authorized agent submitting a request on behalf of our consumer, please submit the request to us at privacy@tympanon.llc. We may require documentation to authenticate the consumer’s identity and that you are authorized to submit the request on the consumer’s behalf in order to be able to fulfill your request. Please keep in mind that if we cannot authenticate that you are authorized to act on the consumer’s behalf or we cannot authenticate the consumer’s identity, we may deny the request.
